Chambers When Janet Milliken and her two children moved from California to a suburb of Philadelphia in 2007, they didn't know that the house they bought was the site of a bloody murder-suicide. Soon after moving in, they began to experience strange happenings. Was the house haunted by the man and wife who had died violently in the house? Believing that to be the case, Milliken sued the seller to have the sale of the house rescinded on the grounds that he had not fully disclosed the history of the house."The Ghosts of Pickering Trail" is the story of what happened in the legal system as Ms. Milliken's lawsuit worked its way through the courts. The issue that was argued was not whether a haunting is one of the material defects that sellers are obligated to disclose to a potential buyer. It's extremely unlikely that any court in the United States would legally recognize the existence of poltergeists, but if the occupants of a house have some basis to believe that there are paranormal beings in the house, at best they're likely to be uncomfortable, and if they observe what they believe to be malevolent actions toward them, they may be terrified. But would the courts rule that psychological stigma constitutes a material defect, with the resulting impact on the value of the property?It's an intriguing story. In deciding to sue the seller, Ms. Milliken used the services of a man who literally wrote the book on evaluating and appraising stigmatized properties. His first big test had been to evaluate the Nicole Brown Simpson condominium where she and her friend Ron Goldman had been murdered in 1994. There was no physical damage to the property, but the stigma was real. Based on suggestions made by the appraiser, Simpson's father was able to sell the property, although well below the asking price. Other interesting tidbits include the origin of the term "coffin corner."It's fascinating material, presenting a complicated legal story in a way that made it very understandable. After reading the story, you can decide for yourself if the courts made the right call.

Excellent Treatise On Haunted Homebuyimg By Dr.K Buyer beware: some states require disclosure of economic depreciation of a home caused by psychological trauma within--violent deaths--that create stigma, and some states do not require disclosure. Haunted or not--would you want to pay full market value for the house In which Adam Lanza shot his mother and thought up the scheme of murdering 20 preschoolers--or not? Wouldn't you at least want to know that the house you were buying was so stigmatized? This little gem of a book offers, in the style of the New Journalism, a dissertation on what constitutes a home's psychological stigma and a scientific analysis for determining, in courts, market value and case history precedent.

By PCCnyc I would call this a case study dealing with the subject of whether a homeowner must reveal if anything violent or traumatic happened in his or her home when selling it. The Milliken family move into a house where unbeknownst to them a murder/suicide took place. Through neighbors and classmates of the children, the truth comes out. The family then starts to believe that paranormal behavior is happening in the home, and they want out, contacting the seller about getting their money back. Court room drama thus commences.The most fascinating part of this Kindle Single is the "Master of Disaster" real estate appraiser who devised a system of figuring out how much value a house loses depending on what horror happened there. Talk about finding a need and filling it!I don't believe in ghosts, however I admit that I would be creeped out if I found out something truly horrific happened in my house. It's an interesting subject to ponder, and definitely worth a read.
